INTRODUCTION

Art. 1 Scope

1.1 These General Terms and Conditions of Sale apply to all sales made by the Seller on the Site.

1.2 Entering an Italian tax code (codice fiscale) when making a purchase means that you are acting as a Consumer within the meaning of art. 3, paragraph 1, letter a) of the Italian Consumer Code (Legislative Decree no. 206 of 6 September 2005). Entering a VAT number means the purchase is made as a “Professional”.

1.3 The time periods indicated are to be understood as working days. Images and descriptions on the Site are indicative only.

1.4 These General Terms and Conditions of Sale may be amended at any time and new versions take effect once published on the Site.

1.12 All elements of the Site are the exclusive property of the Seller or of their respective rights holders. Unauthorised reproduction is prohibited.

1.13 The Seller may not under any circumstances be held liable for indirect or consequential damages arising from use of the Site.

Art. 2 Purchases on the Site

2.1 To make purchases on the Site you must follow the checkout process and provide the requested details. The sales contract is deemed concluded when the order reaches the Seller's server.

2.3 The user warrants that the personal information provided is truthful and complete.

2.5 To place orders on the Site you must read and accept these General Terms and Conditions of Sale.

2.7 After the purchase, the user will receive an order confirmation by email.

Art. 3 Product availability

3.1 The Products offered on the Site are limited in number. Should the Product ordered no longer be available, the user will be informed promptly.

3.4 In the event of a refund for unavailability, the Seller will issue the credit within a maximum of 15 days.

Art. 4 Prices and shipping

4.1 All prices shown on the Site are inclusive of VAT.

4.3 The Seller reserves the right to change the price of Products at any time without notice, on the understanding that the price charged will be the one in effect when the order is placed.

4.5 The Seller will ship the Products only after confirmation that the Total Amount Due has been paid.

Art. 5 Payment methods

5.2 Purchases can be made on the Site using enabled payment cards, in compliance with the PSD2 directive (Strong Customer Authentication). Confidential financial data does not pass through the Seller's servers.

5.6 Purchases can also be made through the secure PayPal circuit.

Art. 6 Delivery of Products

6.1 Shipping and delivery of the Products is available throughout the European territory.

6.3 Indicative delivery time from when the order is placed: approximately 5 working days.

6.4 Users are advised to check that the parcel is intact on delivery and to sign subject to reservation if the packaging shows signs of tampering.

Art. 7 Right of withdrawal

7.3 Where the buyer qualifies as a Consumer, they have the right to withdraw from the contract within 14 calendar days of receiving the product, without giving any reason.

Exceptions to withdrawal: the right of withdrawal does not apply to goods made to measure or clearly personalised (art. 59 of the Italian Consumer Code).

7.4 Every product is delivered with a guarantee seal, a band fitted around the bridge of the frame, certifying that it is intact. The buyer may try the product and check its nature, characteristics and functioning while keeping the seal intact. Removing, breaking or tampering with the seal causes the right of withdrawal to be lost, as the goods are then deemed used beyond what is necessary for that check (art. 57 of the Italian Consumer Code).

Return costs: the direct shipping costs of returning the product are borne by the buyer. The Seller does not accept cash-on-delivery or freight-collect parcels.

7.5 The return must be made within 14 days of the withdrawal notice, using a tracked shipment and suitable packaging. The risk of the return shipment is borne by the buyer until the Seller receives the product.

7.6 In the event of valid withdrawal, the Seller will refund the Total Amount Due within 14 days of the withdrawal notice, excluding return costs. Products must be returned intact, unused, with the guarantee seal undamaged and in their original packaging, complete with all accessories and documentation.

Art. 8 Legal Guarantee of Conformity

8.1 The Legal Guarantee of Conformity is reserved for Consumers and covers any lack of conformity appearing within 2 (two) years of delivery of the goods.

8.6 For purchases made by Professionals, the guarantee is governed by the rules of the Italian Civil Code (art. 1490 et seq.).

Art. 9 Applicable law and jurisdiction

9.1 Purchase contracts concluded through the Site are governed by Italian law.

9.3 For any dispute with a Consumer, the competent court is that of the consumer's place of residence or domicile.
